These Terms of Service (“Terms”) govern your access to and use of the Myoviq website at www.myoviq.com (the “Website”), the Myoviq pre-launch waitlist, and (when released) the Myoviq mobile application and merchandise store (together, the “Services”). The Services are operated by Myoviq (“Myoviq”, “we”, “us”, or “our”).
By accessing the Website or joining the waitlist, you agree to these Terms. If you do not agree, please do not use the Services.
Acceptance of terms
By visiting the Website, submitting your email to the waitlist, or otherwise using any part of the Services, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy, which is incorporated here by reference.
Eligibility
You must be at least 18 years old and capable of forming a binding contract under the Indian Contract Act, 1872 (or the equivalent law of your country) to use the Services. If you are under 18, you may not use the Services without verifiable parental or guardian consent.
The Services
Today, the Services consist of (a) the Website and (b) a pre-launch waitlist. In the future, we intend to release a mobile application offering workout logging, nutrition tracking, goal coaching, and a merchandise store.
Features, pricing, and launch timing are indicative and may change. We may add, remove, or modify any feature at our discretion and will provide reasonable notice of material changes.
Waitlist & early-bird pricing
Joining the waitlist means we may contact you about Myoviq launch updates, beta access, and promotional offers you have opted into. Joining the waitlist is free and does not create any obligation on you or us beyond this.
Early-bird pricing terms
Where we offer rate-locked early-bird pricing (e.g., "first 100 users at ₹299/month locked forever"), the following applies:
- The price is locked for the early-bird user for as long as their subscription remains active and uninterrupted on the same tier.
- If the subscription is cancelled, paused for longer than 30 days, or downgraded, the early-bird rate is forfeited and re-subscribing will be at then-current pricing.
- Early-bird pricing applies only to the subscription tier listed and does not extend to higher-tier upgrades, add-ons, or merchandise.
- Eligibility for an early-bird slot is determined by order of valid sign-ups on launch day and is non-transferable.
- We reserve the right to verify and, where necessary, revoke early-bird benefits in the event of fraud, abuse, or misrepresentation.
User accounts
When the Myoviq application launches, you will need to create an account. You are responsible for:
- Providing accurate, current, and complete information.
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
Notify us immediately at hello@myoviq.com if you suspect unauthorised access. We are not liable for losses caused by your failure to safeguard your credentials.
Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law.
- Reverse-engineer, decompile, scrape, or attempt to extract source code from the Services.
- Submit false information, impersonate any person, or misrepresent your affiliation.
- Interfere with or disrupt the Services, including via denial-of-service attacks, malware, or excessive automated requests.
- Use the Services to harass, threaten, defame, or harm others.
- Resell, sublicense, or commercially exploit the Services without our written consent.
We may suspend or terminate access for violations of this section without prior notice.
Health & fitness disclaimer

Myoviq provides general fitness and nutrition information and tools. It is not medical advice and is not a substitute for professional medical advice, diagnosis, or treatment.
Before starting any exercise programme, changing your diet, or relying on any information or feature provided by the Services, you should consult a qualified medical professional — particularly if you are pregnant, nursing, recovering from injury, have a chronic condition, or take medication.
You assume full responsibility for any decisions you make based on the Services. Myoviq is not liable for any injury, illness, or loss resulting from your use of the Services.
If you experience pain, dizziness, or any concerning symptoms during exercise, stop immediately and seek medical attention.
User content
You retain ownership of any content you submit to the Services (e.g., feedback, reviews, workout logs, photos). By submitting content, you grant Myoviq a worldwide, royalty-free, non-exclusive, sub-licensable licence to use, host, store, reproduce, modify, and display that content solely for the purpose of operating, improving, and promoting the Services.
You are solely responsible for the content you submit. Do not submit content that is unlawful, infringing, defamatory, obscene, or that you do not have the right to share. We may remove content at our discretion.
Subscriptions, billing & refunds
When paid plans launch:
- Subscriptions auto-renew monthly or annually depending on the plan you choose, until cancelled.
- Payments are processed by our payment partner Razorpay. We do not store full card details on our systems.
- You can cancel at any time from within the app. Cancellation takes effect at the end of your current billing period and you retain access until then.
- Refunds: Subscription fees are generally non-refundable for partially used billing periods. If you believe you have been incorrectly billed, contact billing@myoviq.com within 7 days of the charge and we will review your request in good faith.
- We may change pricing for new subscribers at any time. Existing subscribers will receive at least 30 days' notice of price changes affecting them.
Merchandise store
When the Myoviq merchandise store opens, the following will apply:
- Product descriptions, images, and prices are provided in good faith but may contain errors. We reserve the right to refuse or cancel any order in case of pricing error, suspected fraud, or stock unavailability.
- Shipping timelines are estimates, not guarantees.
- Returns and refunds for merchandise will follow the policy displayed on the store at the time of purchase.
- Risk of loss and title pass to you upon delivery.
Intellectual property
The Services, including all software, content, branding, logos, designs, and trade marks (including "Myoviq" and "mind · muscle · meaning"), are owned by Myoviq or its licensors and are protected by Indian and international intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Services for personal, non-commercial purposes only. No other rights are granted.
Third-party services
The Services may contain links to or integrations with third-party websites and services (e.g., Razorpay, WhatsApp, Google, Apple). We are not responsible for the content, policies, or practices of any third party. Your interactions with third parties are governed by their own terms and privacy policies.
Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or for any other operational, legal, or security reason. You may stop using the Services and request deletion of your data at any time by emailing hello@myoviq.com.
Sections that by their nature should survive termination (including IP, disclaimers, liability, indemnity, and governing law) will continue to apply.
Disclaimer of warranties
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Myoviq disclaims all warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.
We do not warrant that the Services will be error-free, secure, or that any defects will be corrected.
Limitation of liability
To the maximum extent permitted by law, in no event shall Myoviq, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of (or inability to use) the Services.
Our total aggregate liability to you for any claim arising out of or relating to the Services shall not exceed the greater of (a) the amount you have paid to Myoviq in the twelve (12) months preceding the claim, or (b) ₹5,000.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless Myoviq, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any content you submit.
Governing law & jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict-of-laws principles.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at [TO BE INSERTED — e.g., Mumbai, Maharashtra], India.
Before initiating any formal proceeding, you agree to first contact us at hello@myoviq.com and attempt to resolve the dispute in good faith for at least 30 days.
Changes to terms
We may revise these Terms from time to time. If we make material changes, we will notify you by email (where we have one) and by updating the "Last updated" date above. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
